Overview

This privacy policy (“Policy”) discloses the privacy practices for the yakabod.com website and various related services (together referred to as the “Site”). Yakabod Inc., the provider of the Site (referred to as “Company”), is committed to protecting the online privacy of users of this Site (each, a “User”).

Each User acknowledges that this Policy is a part of the terms of use of this Site (the “Terms of Use”) and by accessing or using this Site, each User agrees to be bound by all of the terms and conditions of this Policy. Each User must agree to this Policy and the Terms of Use or must not access or use this Site.

Company reserves the right to change, modify, add to or delete from this Policy at any time. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting the revised Policy on this Site. Each User acknowledges and agrees that it is such User’s responsibility to review this Site and this Policy periodically and to be aware of any changes. Each User’s continued use of this Site after such changes will constitute such User’s: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy.

1. Types of Information Collected

In order to better provide Users with services, Company collects two types of information about Users, Personally Identifiable Information and Non-Personally Identifiable Information. Company’s primary goal in collecting information from Users is to provide Users with a smooth, efficient, and customized experience while using this Site.

Personally Identifiable Information: This refers to information that lets the Company know the specifics of who a User is. When a User engages in certain activities on this Site, such as submitting content and/or posting content in discussion forums or other public areas, filling out a survey, or sending the Company feedback, Company may ask such User to provide certain information by filling out and submitting an online form. It is completely optional for any User to elect to engage in these activities, however, Company may ask that a User provide the Company personal information, such as first and last name, mailing address (including zip code), email address, and other personally identifiable information. Depending upon the activity, some of the information Company asks a User to provide is identified as mandatory and some as voluntary. If a User does not provide the mandatory data with respect to a particular activity, such User will not be able to engage in that activity.

Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. Company gathers certain information about Users based upon Users use this Site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the uniform resource locator (“URL”) of the website from which a User came before accessing this Site, the URL of the website to which a User goes after leaving this Site, what browser a User is using, and the internet protocol (“IP”) address of aUser.

2. Collection Methods and Use of Information

Company does not collect any Personally Identifiable Information about a User unless such User voluntarily provides such information to the Company.

Company may collect, or Company’s Affiliates or third-party service providers may collect, certain Non-Personally Identifiable Information. This information is ultimately stored in the form of store categories, and, in some cases, specific URLs. Company uses Users’ respective IP addresses to diagnose problems with Company’s servers and software, to administer this Site and to gather demographic information.

Company will primarily use Personally Identifiable Information to provide Company’s services, as required by the Terms of Use or other User agreements. Company will also use Personally Identifiable Information to enhance the operation of this Site, fill orders, improve marketing and promotional efforts, statistically analyze Site use, improve product and service offerings, and customize this Site’s content, layout, and services. Company may use a User’s Personally Identifiable Information to deliver information to such User and to contact such User regarding administrative notices. Company may also use a User’s Personally Identifiable Information to resolve disputes with, troubleshoot problems of and enforce agreements with such User, including the Terms of Use and this Policy.

3. Release of Information

Company does not sell, trade, or rent Personally Identifiable Information to others. Company provides some services through contractual arrangements with Affiliates, service providers, partners and other third parties. Company and its service partners use Personally Identifiable Information to operate their respective websites and to deliver their respective services. For example, Company or a third party must:(a) release a User’s credit card information to the card-issuing bank to confirm payment by such User for purchased products and services; (b) release a User’s address information to the delivery service to deliver ordered products to such User; or (c) provide order information to third parties that help Company provide customer service.

Company will encourage its service partners to adopt and post privacy policies. However, the use of your Personally Identifiable Information by Company’s service partners is governed by the privacy policies of those service partners and is not subject to Company’s control.

Occasionally Company may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. Company will disclose Personally Identifiable Information upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. Company fully cooperates with law enforcement agencies in identifying those who use Company services for illegal activities. Company reserves the right to report to law enforcement agencies any activities that Company in good faith believes to be unlawful.

Company may also provide Non-Personally Identifiable Information about Company’s sales, traffic patterns, and related Site information to third-party advertisers or analytics services, but these statistics do not include any Personally Identifiable Information.

4. Updating and Correcting Information

Each User has the ability to access and edit such User’s Personally Identifiable Information that has been provided to Company. A User may access and correct such User’s Personally Identifiable Information by making contact with the Company at info@yakabod.com. A User must include such User’s name, address, and/or email address when making contact with the Company.

Company encourages Users to promptly update their respective Personally Identifiable Information if it changes.

A User may request Company to delete such User’s Personally Identifiably Information, however Personally Identifiably Information associated with past transactions on this Site cannot be deleted. In addition, it may be impossible to completely delete Personally Identifiably Information because of backups of this Site.

5. User Choices on Collection and Use of Information

Company may, from time to time, send Users email regarding Company products and services. If a User does not want to receive such email, such User can use the unsubscribe option provided on such email or otherwise notify the Company at the contact information provided in this Policy.

A User also has choices with respect to cookies, as described below. By modifying browser preferences, a User has the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of this Site may not work properly in your case.

6. Security of Information

The Company protects Personally Identifiable Information and Non-Personally Identifiable Information according to current industry standards.

Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. As a result, while Company strives to protect Personally Identifiable Information, each User acknowledges that: (a) there are security and privacy limitations of the internet which are beyond Company’s control; (b) the security, integrity and privacy of any and all information and data exchanged between such User and Company through this Site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

7. Cookies

When a User uses this Site, Company will store cookies on such User’s computer in order to facilitate and customize use of this Site. A cookie is a small data text file, which a website stores on a User’s computer’s hard drive (if permitted by a browser) that can later be retrieved to identify such User to Company. Company cookies store randomly assigned user identification numbers and the country where a User is located. The cookies make use of the Site easier, make the Site run more smoothly and help Company to maintain a secure Site. A User is always free to decline cookies, if the User’s browser permits, but some parts of this Site may not work properly in that case.

Company may use a third-party service provider to display banner advertisements on this Site. As part of such service, such provider will place a separate cookie on User’s respective computers. Company will not provide any such third-party service provider with any Personally Identifiable Information or information about purchases. Company and such third-party service provider will collect and use Non-Personally Identifiable Information, such as IP address, browser type, the server onto which a computer is logged, area code and zip code associated with such server and whether a User responded to a particular ad. Other third-party service providers may also place banner ads on this Site in the same manner as above, but Company will not disclose any Personally Identifiable Information to such third-party service providers.

8. Privacy Policies of Third-Party Sites

Except as otherwise discussed in this Policy, this Policy only addresses the use and disclosure of information Company collects from Users. Any other website accessible through this Site may have its own privacy policy or other practices. Company is not responsible for the policy or practices of third parties. Additionally, third-party companies which place advertising on this Site may collect information about Users when Users view or click on such advertising through the use of cookies. Company cannot control this collection of information. Users should contact directly such third-party companies about any questions about use of the information that they collect.

9. Children’s Online Privacy Protection Act (“COPPA”)

Company does not specifically market to individuals under the age of 13. No individual under the age of 13 is permitted to enter any Personally Identifiable Information on, use, view, or otherwise browse this Site or any services provided thereon.

No individual under the age of 18, or such age of majority as may apply in such individual’s location, is permitted to enter any Personal Identifiable Information on, use, view, or otherwise browse this Site or any services provided thereon without the express written consent of such individual’s parent or legal guardian, and such consent must be provided to Company.

If a parent or legal guardian believes such parent’s or legal guardian’s child or ward under the age of 13, or without consent if under the age of 18, has provided Company with Personally Identifiable Information, please notify the Company at the contact information provided in this Policy.

10. Fair Information Practices:

In order to comply with Fair Information Practices, Company will take the following responsive action, should a data breach occur: Company will notify Users via email within ten (10) business days of any known breach.

12. General Data Protection Regulation (“GDPR”)

All information received by Company is stored and processed, if at all, in the United States. By using this Site, each User consents to the transmission of such User’s information to, and the storage and processing of such information in, the United States. Company will keep a User’s information until the earlier of: (a) such User’s request to delete such information or (b) Company decides it no longer needs such information and the cost of retaining it outweighs the value to keeping it. A User may access, rectify or request the erasure of such User’s Personally Identifiable Information by notifying the Company at the contact information provided in this Policy. A User may withdraw such User’s consent to the Company’s processing of such User’s information, provided, however, that such withdrawal shall have no effect on the lawfulness of the processing of information prior to such withdrawal. A User may lodge a complaint with the supervisory authority that has jurisdiction over GDPR issues in such User’s location.

13. California Privacy Rights

California residents are entitled to ask for a notice identifying the categories of Personally Identifiable Information which Company shares with its Affiliates and/or third parties for marketing purposes and providing contact information for such Affiliates and/or third parties. Users residing in California may submit a written request for such notice to the contact information provided in this Policy.

14. Miscellaneous

If a User voluntarily discloses Personally Identifiable Information a public area on this Site, such information, along with any other information disclosed, can be collected and used by third parties and may result in unsolicited messages from third parties. Such third-party activity is beyond Company’s control, and this Policy does not apply to any information voluntarily disclosed in a public area on this Site. Any submissions to a public area on this Site are accepted with the understanding that they are accessible to all third parties. If a User does not want such User’s information to be viewed by third parties, such User must not make any submissions to public areas on this Site.
